About These Terms

These terms apply to the Molteno Couture website and to enquiries and booking requests made through it. Molteno Couture is operated by Rose Molteno from 12 Price Drive (Bonair), Wittenboomen, Constantia, Cape Town, South Africa. Our contact details appear below.

A website request does not by itself confirm an appointment or create an order. We will confirm availability and the applicable scope, price, deposit, timing, and other material terms in writing. If a signed quotation or service agreement conflicts with these website terms, the signed document applies to that service. Nothing in these terms removes a right that cannot lawfully be excluded under the Consumer Protection Act or other applicable law.

Services

Molteno Couture provides custom couture design services, including:

  • Bridal gown design and creation
  • Matric dance dress design
  • Evening wear and special occasion gowns
  • Personal styling consultations
  • Alterations and custom fitting services

Bookings and Cancellations

Appointments are subject to availability and written confirmation. We may need to reschedule an appointment and will give reasonable notice where circumstances allow. If we cancel and cannot offer a suitable alternative, we will refund any amount paid for that appointment.

You may cancel an advance booking as permitted by applicable law and the written terms provided when it is confirmed. Any cancellation charge will be reasonable in the circumstances and may take account of notice given, work already performed, materials ordered, and our reasonable ability to fill the reserved time. Special-order goods may be treated differently where the law permits.

Orders and Payments

A reasonable deposit may be required before we reserve production time, order materials, or start work. The amount, due dates, accepted payment methods, and the circumstances in which an amount may be retained will be disclosed before you agree to proceed.

Unless otherwise agreed in writing, the balance is due before final delivery. If you cancel, we may retain or recover only amounts permitted by the agreement and applicable law, including reasonable amounts for completed work, committed materials, and cancellation.

Prices are quoted in South African Rand (ZAR). A quote will state what is included and how long it remains valid. We will obtain your approval before carrying out work that materially increases the agreed price.

Custom Design Process

The design, materials, fittings, estimated timeline, and delivery arrangements will be agreed for each order. Timelines are estimates unless we expressly agree to a fixed date. We will tell you if a material delay becomes likely.

You are responsible for providing accurate information and attending agreed fittings. Changes in measurements, missed fittings, late approvals, or delayed information may affect fit, price, and timing.

Requested changes are subject to feasibility. We will explain any material effect on price or timing and obtain your approval before proceeding.

Quality, Returns, and Remedies

Custom and personalised items generally cannot be returned merely because you change your mind. This does not limit your rights if goods or services do not meet applicable quality standards or the agreed specification. Please tell us promptly about a concern and allow us a reasonable opportunity to inspect and remedy it. Any repair, replacement, refund, or other remedy will be handled in accordance with applicable law and the circumstances.

Intellectual Property

We retain intellectual-property rights in our original designs, sketches, website content, and other creative work except where we agree otherwise in writing. You retain rights in images and materials you provide and give us permission to use them only as needed to respond to you and provide the requested service. We will obtain permission before using identifiable client photographs or personal information for public marketing.

Website Use

Website content is general information and may change. Images, colours, and fabric appearance can vary by screen and do not by themselves form a product specification. You may not misuse the website, attempt unauthorised access, interfere with its operation, or copy protected content except as permitted by law. Third-party links are provided for convenience and are subject to their own terms and privacy practices.

Liability

To the fullest extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. We do not exclude or limit liability where doing so would be unlawful, including liability for gross negligence or rights and remedies that applicable consumer law protects.

Clients Under 18

A parent or legal guardian must make or approve a booking and enter any service agreement for a client under 18. The guardian is responsible for approvals and payments under that agreement.

Disputes and Governing Law

Please contact us first so we can try to resolve a concern directly. These terms are governed by South African law. You may use any complaint, ombud, regulator, tribunal, or court process available to you under applicable law. Any agreed choice of court is subject to those rights.

Changes to Terms

We may update these website terms by posting a revised version and changing the date above. A change will not retrospectively alter an existing confirmed order or signed service agreement unless the parties agree or the law requires it.
